On March 25, 2009, Edwards Angell Palmer & Dodge’s Insurance and Reinsurance Department presented its 2009 Annual Review Seminar in London, addressing some of the important legal and regulatory issues affecting the industry over the last 12 months. The seminar was chaired by Adrian Williams, Head of Legal, QBE European Operations.
Strategies for the Brave New World by Richard Spiller Richard discussed the use of recent EU legislation to restructure and rationalise European underwriting operations to gain capital and regulatory efficiencies. He also addressed approaches that can be taken by cedents to protect their reinsurance assets, including alternative security structures and other types of default protection.
Current Developments in US Regulation by John P. Dearie Jack discussed the most recent initiatives regarding the federal regulation of insurance, ie. the "National Insurance Consumer Protection and Regulatory Modernization Act" and the "Non-admitted and Reinsurance Reform Act." He also spoke on proposed legislation that would correct an alleged flaw in the current US tax system that provides economic advantages to foreign property and casualty insurers domiciled in favourable tax jurisdictions, such as Bermuda. Finally, Jack addressed proposals by the NAIC and New York that would relax collateral requirements for unauthorized reinsurers.
