The Privacy and Data Protection Group of Edwards Angell Palmer & Dodge hed a 60 minute complimentary webinar entitled "Local Issue/National Challenge: March 1 Massachusetts Data Security Requirements" on February 11, 2010.
This webinar addressed the Massachusetts Security Regulation in view of its looming March 1, 2010 deadline. The Massachusetts requirements, which apply to the personal information of Massachusetts residents, have had nationwide implications for companies with Massachusetts customers or employees, and for vendors that provide services to those companies. The webinar discussed:
The national reach of the Massachusetts requirements, including encryption of laptops and other devices
The process needed to comply with the Massachusetts requirements, including assessment of personal information, review of and coordination or replacement of existing policies
The requirements for a Written Information Security Program containing various required elements for data protection
The requirements for existing and new vendor contracts
The looming March 1 deadline
Interplay between the Massachusetts and Federal Red Flags requirements
The Speakers were the following Partners in EAPD's Privacy and Data Protection Group:
Mark E. Schreiber - Mark is Chair of the firm's Privacy and Data Protection Group, and also Co-Chair for Privacy Matters of the World Law Group, an international affiliation of large law firms. He helped found and was Co-Chair of the Boston Bar Association's Privacy Committee. Among his practice areas are state data security regulations, E.U. data protection and cross-border data transfer, including adapting Sarbanes-Oxley hotlines abroad, and he co-authored the ABA text chapter on this subject. He has handled a number of HIPAA, medical, Gramm Leach, U.S. Safe Harbor and E.U. privacy and security and data breach matters for financial services, biotech and high tech companies, and universities and colleges in the US, EU and Asia.
Theodore P. Augustinos - Ted is a member of the EAPD Privacy and Data Protection Group, and its Insurance and Reinsurance Department. He has advised financial services firms, including insurance companies and producers, and educational, charitable and business organizations of all sizes on compliance with federal and state privacy, data security and data breach notification requirements, including nationwide breach incidents involving millions of consumers. In these matters, he has represented clients before various state and federal regulatory and enforcement agencies. Ted also represents insurance companies and producers, banking institutions and other clients in a wide variety of transactional, regulatory and corporate matters, including mergers and acquisitions.
The EAPD Privacy and Data Protection Group now includes our Breach Response Team, of which both Ted and Mark are members.
