The Insurance and Reinsurance Department of Edwards Angell Palmer & Dodge held a 60 minute complimentary webinar entitled "Emerging Trends in Asbestos Litigation: US/UK/European Issues and Perspectives" on Tuesday, May 25, 2010.

This presentation provided an overview of the important issues in asbestos litigation in the US, UK and Continental Europe.

US Update

  • Asbestos Bankruptcy Trust (from a defense perspective)
  • Multidistrict litigation 875 ("Asbestos MDL")
  • Emerging global threat for US businesses facing possible asbestos lawsuits in US Courts for asbestos-related injuries sustained in other countries
  • Allocation and other reinsurance issues related to asbestos litigation and settlements.

UK Update

  • Main developments in UK asbestos liability.

EU Update

  • The asbestos liability problem in the EU and other countries in Continental Europe.

Presenters:

Rebecca Hartley has worked on a wide variety of contentious commercial insurance and reinsurance matters and has experience of both arbitration and litigation, often with an international element.

Richard Hopley handles complex insurance and reinsurance coverage disputes (particularly those involving product liability or innovative insurance products) in litigation or arbitration. He is currently acting in a number of significant disputes involving insurance and reinsurance coverage for US and UK asbestos liabilities.

Christopher M. Tauro focuses on complex civil litigation. He has extensive federal and state litigation experience. He has represented a broad spectrum of clients in commercial litigation from Fortune 500 companies, insurance companies, small businesses to individuals. He has mediated matters and litigated and tried lawsuits in state and federal courts in multiple jurisdictions.

Michael P. Thompson advises national and international clients in major insurance and reinsurance matters. He has substative experience in the litigation and arbitration of disputes involving product liability, property and casualty, life and health, financial and marine excess of loss business.
