Lynn has a broad based environmental practice that encompasses litigation, regulatory counseling, as well as transactional matters. As a state and federal regulator and enforcer for over nine years, she brings unique experience to our clients. Lynn also represents our clients in toxic tort matters, public and private corporations and universities in government and private cost recovery litigations. Lynn often acts as common group counsel in remediation litigation. In addition to environmental litigation, Lynn has considerable experience in complex general and commercial litigation.
Notable Experience
- Successfully defended a client in a breach of contract claim, discrimination based on National origin and defamation claim in an eight-day jury trial.
- Argued first successful challenge to the constitutionality of the lien provisions of the federal Comprehensive Environmental Response Compensation and Liability Act (Superfund) in the United States Court of Appeals for the First Circuit.
- Successfully negotiated the settlement of federal government's claim for cost recovery at a superfund site for an unprecedented 70% of the federal government's claim.
- Litigated on behalf of various clients at numerous superfund sites throughout the country. At many of the sites she has acted and continues to act as the common counsel relating to litigation and remediation issues.
- Represented client in numerous toxic tort claims filed against it relating to the alleged impacts of a superfund site in Texas, including but not limited to, claims for diminution of property value, medical monitoring, alleged personal injuries and fear of cancer.
- Litigated toxic tort claims relating to the alleged impact of disposing of waste in an abandoned quarry in Pennsylvania, including claims of alleged diminution of property value, fear of cancer, personal injury and medical monitoring.
- Negotiated numerous settlements of pre-treatment enforcement actions under the federal and state delegated NPDES programs; administrative civil penalty actions under CERCLA, Clean Water Act and Clean Air Act and TSCA registration of new chemicals for importation matters.
- Represented client in breach of contract and fraud litigation.

Prior to joining the firm, Lynn was an Assistant Regional Counsel with the United States Environmental Protection Agency in New York. Prior to joining the EPA, Lynn was with the Pennsylvania Department of Environmental Resources, where she litigated under air, water and solid waste laws.

Lynn volunteers for the Eye Bank for Sight Restoration, where she speaks at various hospitals and health care organizations on cornea donation. In addition, she is active in an independent theatre group.
